Welcome to Umuve. These Terms of Service ("Terms") govern your access to and use of the Umuve mobile applications (Umuve customer app and Umuve Pro operator app), website (goumuve.com), and all related services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
Umuve is a technology platform that connects customers seeking junk removal, hauling, and related services ("Customers") with independent service providers ("Operators") who perform those services. Umuve acts as a marketplace and does not itself perform junk removal or hauling services.
- Umuve facilitates the booking, payment, and communication between Customers and Operators
- Operators are independent contractors, not employees or agents of Umuve
- Umuve does not guarantee the availability, quality, or timeliness of any Operator's services, though we strive to maintain high standards across our platform
2. Eligibility
You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.
3. User Accounts
- You may be required to create an account to access certain features of the Service
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You agree to provide accurate, current, and complete information during registration and to update it as necessary
- Umuve reserves the right to suspend or terminate accounts that violate these Terms
4. User Responsibilities
For Customers
- Provide accurate descriptions and, when applicable, photos of items to be removed
- Ensure safe and reasonable access to the pickup location for Operators
- Be present or available at the scheduled pickup time, or designate an authorized representative
- Do not request removal of hazardous materials, biohazards, or items prohibited by law
- Treat Operators with respect and courtesy
For Operators
- Maintain all required licenses, permits, and insurance for hauling and junk removal in your service area
- Perform services professionally, safely, and in compliance with all applicable laws
- Dispose of removed items in accordance with local regulations, including proper recycling and donation where possible
- Communicate promptly with Customers regarding job status and any volume adjustments
- Treat Customers and their property with respect
5. Booking and Pricing
- Pricing is based on the estimated volume of items to be removed, as determined during the booking process
- Final pricing may be adjusted if the actual volume differs from the estimate, subject to Customer approval
- Umuve provides price estimates in good faith but does not guarantee that final charges will match estimates
- All prices are listed in U.S. dollars and are inclusive of standard service fees
6. Payment Terms
- All payments are processed securely through Stripe, our third-party payment processor
- By providing payment information, you authorize Umuve to charge your payment method for services booked through the platform
- Umuve does not store your credit card numbers; all payment data is handled by Stripe in accordance with PCI-DSS standards
- Operator payouts are processed through Stripe Connect and are subject to Stripe's terms and processing timelines
- You agree to pay all charges incurred through your account, including applicable taxes and fees
7. Cancellation and Refund Policy
Customer Cancellations
- Before Operator dispatch: Cancellations made before an Operator has been dispatched are eligible for a full refund
- After Operator dispatch: Cancellations made after an Operator has been dispatched may be subject to a cancellation fee to compensate the Operator for time and travel
- No-shows: If a Customer is not available at the scheduled pickup time and has not communicated a delay, the booking may be cancelled and a fee may apply
Refunds
- Refund requests must be submitted within 48 hours of service completion by contacting support@goumuve.com
- Refunds are evaluated on a case-by-case basis and may be issued for incomplete service, significant quality issues, or billing errors
- Approved refunds are processed back to the original payment method and may take 5-10 business days to appear
Operator Cancellations
- If an Operator cancels a confirmed booking, Umuve will attempt to assign a replacement Operator or issue a full refund to the Customer
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Harass, threaten, or discriminate against any user of the platform
- Provide false or misleading information in bookings, reviews, or account details
- Attempt to circumvent the platform to avoid service fees (e.g., arranging off-platform payments)
- Interfere with or disrupt the Service, servers, or networks connected to the Service
- Scrape, harvest, or collect data from the Service without authorization
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
9. Intellectual Property
All content, trademarks, logos, and intellectual property displayed on the Service are owned by or licensed to Umuve. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without prior written consent from Umuve.
10. Limitation of Liability
To the fullest extent permitted by applicable law:
- Umuve provides the Service on an "as is" and "as available" basis without warranties of any kind, express or implied
- Umuve is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- Umuve is not responsible for the actions, omissions, or conduct of any Operator or Customer, whether on or off the platform
- Umuve's total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to Umuve in the twelve (12) months preceding the claim
- Umuve does not guarantee uninterrupted, secure, or error-free operation of the Service
11. Indemnification
You agree to indemnify, defend, and hold harmless Umuve, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Dispute Resolution
- Any disputes between Customers and Operators should first be reported to Umuve through support@goumuve.com for mediation
- Umuve will make reasonable efforts to resolve disputes but is not obligated to mediate or adjudicate any dispute
- If a dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Florida
- You agree to waive any right to participate in a class action lawsuit or class-wide arbitration
13. Termination
- You may stop using the Service and close your account at any time
- Umuve reserves the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice
- Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive (including liability limitations, indemnification, and dispute resolution) shall remain in effect
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Updating the "Last Updated" date at the top of this page
- Sending an email notification for significant changes
- Displaying an in-app notification
Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Florida.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Umuve regarding your use of the Service and supersede all prior agreements and understandings.
